Mr. David Jia Worked as a Party-Appointed Expert Witness in an ICC Arbitration Proceeding

Recently Mr. Hongwei (David)Jia, the managing partner of Longan Shenzhen Office, submitted an English version Expert Report concerning certain Chinese legal issues to the arbitral tribunal in an ICC arbitration proceeding. As a Chinese legal expert witness, Mr. Jia was appointed by a foreign company registered in one of the “Belt and Road” countries. This dispute is related to a construction contract of a mining wharf between the foreign company and an overseas subsidiary of a State-Owned-Enterprise of PRC.

Mr. Jia handled this case in a very professional manner. He worked day and night, reading the case materials, doing the Chinese legal research and factual analysis, and drafting the expert report. Eventually, Mr. Jia submitted the expert report on time in accordance with the requirement of the order which was made by the arbitral tribunal. Afterwards he discussed with the expert appointed by the other party on the subject issues, and submitted a joint expert report to the tribunal. Mr. Jia’s unique and accurate analysis, along with his professional Chinese legal opinions provided a clear and convincing explanation over the subject issues to both of the arbitral tribunal and the other party. As a result, the other party wisely chose to settle this dispute and close the case in the end.

During the process of preparing the expert report, Mr. Jia strictly followed the IBA Rules on the Taking of Evidence in International Arbitration, and insisted on the impartiality, objectivity and unbiasedness. Mr. Jia’s professional attitudes and high caliber service strongly impressed the appointing party and gained high appraisal from all participating parties.
